"Madam President, 800 years ago we established the principle of
that you should not be arrested or detained without purpose, and now in the name of the creation of a European criminal justice system and particularly through the mechanism of the European Arrest Warrant, that principle has been abandoned.
I was involved in a constituency case where a young man in what was very obviously a case of mistaken identity spent two years in detention in Greece, 11 months of it in one of the nastiest prisons in Europe, for the sake of a criminal action that was dismissed almost the moment it came to court because it was so very obviously a false case. Now that is no presumption of innocence; being detained without any charge being brought for that length of time one can only conclude that the process is the punishment. So now, in this anniversary of Magna Carta, to be told that we are going to be given the presumption of innocence by the European Union, I find insulting."@en1
