The determining criterion for the enjoyment of immunity under Article 8 of the Protocol is evidence of a direct and obvious link between the opinions in question and the performance of parliamentary duties. A direct and obvious link has not been provided and the Parliament has previously endorsed that Mr Albertini was not acting in the performance of his duties as a Member of the European Parliament."@en1
