Council Regulation (EC) No 44/2001 (along with its forerunner, the Brussels Convention) is one of the EU’s most successful legal instruments. It laid the foundations for a European judicial area, promoted legal certainty and predictability of decisions and is used as a reference tool by other instruments. The recast version is of considerable importance. Agreement has been reached on points including the abolition of exequatur, the extension of the Regulation’s jurisdiction rules to defendants domiciled outside the EU and choice-of-court and arbitration agreements. The Committee on Legal Affairs is satisfied with the compromise reached with Council, as it corresponds to Parliament’s position in all major points. The abolition of exequatur for all civil and commercial judgments is a significant step forward in access to justice for citizens and businesses."@en1
