"This proposal for a directive is the result of a review of the consumer
which started in 2004 with the aim of simplifying and completing the existing regulatory framework relating to consumer protection. The proposal is intended to ensure that, on the one hand, consumers of the 27 Member States can rely on a high level of protection and, on the other hand, that businesses, regardless of their size, can provide their goods and services to consumers in the 27 Member States without facing unnecessary legal obstacles. In order to avoid the ever greater fragmentation of existing regulations in this area, a targeted full harmonisation approach was sought; that is to say, harmonisation limited to specific aspects of certain contracts, while maintaining a high level of consumer protection. This requires an adjustment of the scope of application. In fact, apart from a series of sectoral exemptions across a wide range of sectors, the directive is restricted to contracts concluded away from business premises, which increasingly constitute a sizeable proportion of cross-border contracts.
