"In spite of the efforts made over the last 10 years to achieve harmonisation in the asylum sector, major discrepancies still remain between national provisions and in the way they are applied. Such discrepancies are incompatible with a common European asylum system and are an obstacle to its development. They run counter to one of the cornerstones of the Dublin system, which is based on the presumption that Member States’ asylum systems are comparable. In whichever Member State applicants lodge an asylum request, they must enjoy the same high level of protection across the whole Union. While legislative harmonisation will not suffice to reduce these differences and will need to be supplemented by practical cooperation among Member States, adopting a sound European legal framework is an absolute prerequisite for the Union to implement a common European asylum system in an adequate and effective manner, just as it has repeatedly pledged to do so. The Commission’s proposal will rectify the mistakes of the past, when the previous approach to asylum encouraged a series of shortcomings regarding procedural guarantees for asylum seekers."@en1
