". − The Commission’s proposal aims to improve the functioning of the internal market by reducing trade barriers across borders, but poses problems for both consumers and manufacturers. It should support all efforts aimed at making the internal market more effective and encourage cross-border trade, but Article 38 of the Charter of Fundamental Rights requires that EU policies ensure a high level of consumer protection. It is therefore necessary to aim to increase the minimum level of current harmonisation by applying available best practices. It will be appropriate to develop a European system of liability in the event of non compliance to improve consumer protection and confidence in the markets. In line with the Europe 2020 Strategy, their high level of protection ensures quality products and at the same time fosters the performance of the internal market. Regarding the rights of consumers, the current minimum regulations allow Member States to adapt European regulations to national principles: we should proceed further in this direction. Unfortunately however, we note that the proposed directive does not take into account new products on the market due to changes taking place in development and innovation, as in the case of digital products."@en1
