I voted in favour of this European Parliament report on enhanced cooperation in the area of the law applicable to divorce and legal separation, because a clear and explicit legal basis must be established, according to which rules would be applied related to the applicable law. I would like to point out that one of the European Union’s main objectives is to maintain and develop an area of freedom, security and justice, in which freedom of movement of persons is guaranteed. The legal situation at European level regarding the law applicable to the divorce and legal separation of spouses of different nationalities is currently very confusing, because it is unclear which law should be applied. This often leads to a ‘rush to court’ where one of the spouses files for divorce before the other one does in order to ensure that the proceeding is governed by a given law which he or she regards as more favourable to his or her own interests. I would like to stress that the new regulation proposed should create legal certainty for the couples concerned and guarantee predictability and flexibility."@en1
