"I should like to congratulate Mr Zwiefka for drawing up this report, which I support. The aim of this measure is to establish a clear, comprehensive legal framework in the legislation applicable to divorce and legal separation, by allowing the parties a certain degree of autonomy. The diversified nature of these rules in the Member States may, in fact, create problems in the case of ‘international’ divorces.
Indeed, as well as the legal uncertainty over the identification of the laws applicable in each individual case, there may also be a ‘rush to court’ to ensure that the proceeding is governed by a given law which better protects one of the two spouses. The European Union must therefore limit these risks and shortcomings by introducing the possibility of choosing the applicable law by mutual agreement between the parties. I therefore agree with the need to ensure the parties fair and accurate information that allows them to be aware of their choices as soon as possible."@en1
