Madam President, ladies and gentlemen, I have voted in favour of the work presented by Mrs Gebhardt, on applicable law in matrimonial matters. It has a worthy aim: to establish a clear and comprehensive legal framework to include laws on jurisdictional competence, and recognition and implementation of decisions on matrimonial matters, in addition to the rules on applicable law.
Indeed, under the current scenario, because of conflicts between national and Community laws, any ‘international’ divorce may throw up the most disparate of legal questions. We must also consider the risk of the ‘dash to court’, which rewards the spouse who attempts to get in first and seize the jurisdiction whose law best serves his or her interests.
This is completely unacceptable, and I therefore welcome this report, aimed at giving the spouses significant responsibilities, above all in terms of enlightened choice, choice of jurisdiction and finally choice of applicable law."@en1
