The rules of Article 4 of the Habitat Directive 92/43/EECincluding Annex III, Stage 1 govern the procedure for the first (national) stage selections of NATURA 2000 sites. The national stage has legal effects on landowners, governments and the Commission, according to the European Court of Justice (ECJ) ruling C-371/98 point 20. These effects relate to the conservation objectives of each site, that is, the objectives identifying the habitat types and the species (including birds) to be protected also under Article 6.3 of the Habitat Directive. It is essential the Commission guarantee that the rules of the first national stage are correctly incorporated into national legislation, following the guidelines set forth by the ECJ, and that national authorities do not arbitrarily misinterpret the rules when drawing up the national lists.
What will the Commission do to help e.g. Finnish landowners who believe national authorities and courts have approved the drawing up of national lists and the selection of the sites in a way which contradicts those rules?"@en1
