Triples with object I voted against this Report as I have grave concerns in relation to the establishment of the European Public Prosecutors Office and the parameters of its remit. Harmonisation will inevitably mean the adoption of the European inquisitorial model to replace the trial by jury system which applies in Ireland and a number of other common law jurisdictions. This has the potential to seriously undermine the presumption of innocence. Basically, this means that an accused person would no longer be treated as innocent before being proven guilty, but that the onus will now be on anyone accused of a crime to prove his or her innocence. The rationale for the development of an EU criminal law is to combat transnational organised crime. The intention is of course to be welcomed but not at the expense of subjugating and undermining the existing judicial systems of individual Member States to the interests of the EU.
