"I welcome the Commission’s proposal for a directive on the strengthening of certain aspects of the presumption of innocence and of the right to be present at trial in criminal proceedings. The presumption of innocence is a fundamental right and a principle which is key to preventing arbitrary judgments and any abuse of process in criminal proceedings, and which underpins protection of the right to a fair trial as set out in Article 6 of the European Convention on Human Rights, Article 48 of the Charter of Fundamental Rights of the European Union, the International Covenant on Civil and Political Rights and the Universal Declaration of Human Rights. The proposal for a directive is made all the more important by the limitation of the rights of suspects and accused persons and the erosion of the principle of the presumption of innocence that is currently being seen in several EU Member States."@en1
