While it is important to guarantee consumer rights by provisions from which it is not possible to derogate by contract, it is reasonable to let undertakings and organisations agree otherwise when they are not dealing with consumers. However, Member States should be able to provide that micro-enterprises, as defined in Commission Recommendation 2003/361/EC, be treated in the same way as consumers. In any case, certain core provisions of this Directive should always apply, irrespective of the status of the user."@en1
