"This report was intended to set uniform contract rules for traders and consumers in cross-border transactions. The rules would co-exist with pre-existing national laws in Member States and, crucially, they would be optional, only applying if parties opt for them in a specific cross-border contract. While I believe that we need to strengthen consumer rights and remove barriers to cross-border trade, I do not believe that the report in its current form will achieve this. As an optional instrument, the common rules would simply create legal uncertainty for consumers and would be unlikely to be offered to consumers in any case if it provided them with greater protection than national law. I therefore voted in favour of the amendments to remove the optional element of the rules and to send the report back to committee for further consideration."@en1
