"The revision of existing EU air passenger rights legislation has its basis in two recent developments: firstly, the travel chaos caused by the Icelandic ash cloud in 2010 and, secondly, more recent judgements by the European Court of Justice. The report attempts to strike a delicate balance between protecting consumers and the competitiveness of European airlines. There are some promising proposals in relation to the former, with clearer rules on how to deal with passenger complaints, faster information made available to passengers (no later than 30 minutes after initial departure time) and an increase in hand luggage allowances. However, there are aspects of the report that I believe could upset the delicate balance it strives for, and would actually serve to work against consumers if implemented. For instance, the decrease in the length of delay for which compensation can be claimed from 5 to 3 hours would actually incentivise airlines to cancel flights to minimise compensation costs, resulting in greater inconvenience for passengers. Crucially, the report does not remove a clause suspending air passenger rights legislation to Gibraltar which, as an EU airport, is a completely discriminatory exclusion. Therefore, I cannot support the report as it currently stands."@en1
