With the Regulation the EU’s intention is to increase legal certainty for citizens and businesses. In place of exequatur, the judgment is to be regarded as if it were given by the courts of the Member State of enforcement. Under certain circumstances a review of the judgment may be applied for at the courts of the Member State of origin. With regard to cross-border litigation in particular it is important that the right to a fair trial is not impaired in any way. However, this principle must not degenerate into a mere instrument of appeal either. That is no easy undertaking. I took this into account in my vote."@en1
