"Mr President, Commissioner, this is a failure of a Directive through and through. As the Commissioner herself has said, it will have a great impact on the right to privacy. There is nothing positive to balance this out. There has not been any harmonising effect, and there is nothing to indicate that this would be effective in fighting crime.
The Directive stated that the Commission should undertake an evaluation by no later than 15 September 2010, but this has never happened. To date, the Commission has not undertaken any proper evaluation at all. Some little anecdotes have been presented to indicate that it might be quite a nice thing to have after all. Many of these anecdotes came before the fact that data storage has been implemented. The Commission has not fulfilled its obligations under this Directive.
Against this background, there is one thing that is very difficult for my voters in Sweden to understand, namely how the Commission can fine Sweden for not having introduced this failed Directive whilst at the same time the Commission itself completely fails to present a proper evaluation as it is obliged to do."@en1
