"For months now, the European Parliament has been negotiating what has become known as the Schengen package under the ordinary legislative procedure. Suddenly, however, the interior ministers changed the legal basis (Article 70), aiming to transfer responsibility for this to the Member States. Behind this perhaps seemingly technical issue hides the basic question behind all European politics: are the Community and its institutions to make decisions based on community principles or are the national governments to perform that function based on more or less agreed positions – in other words, are decisions to be made on a Community or intergovernmental basis? Since the entry into force of the Treaty of Lisbon, the European Parliament has developed more and more into an institution that stands above national special interests. This could, perhaps, act as a brake against populist politics, which occurs regularly in many Member States, especially in the run-up to national elections. It seems clear that Europe’s interior ministers fear that the European Parliament takes its role as guardian of European fundamental rights seriously."@en1
