"The Federal Council of the Swiss Confederation decided to introduce quotas on category B residence permits for stays for up to five years granted to nationals of Poland, Lithuania, Latvia, Estonia, Slovenia, Slovakia, the Czech Republic and Hungary, with effect from 1 May 2012. Switzerland has adopted a number of ‘flanking measures’, accompanying the Free Movement of Persons Agreement, which can hinder the provision of services by EU businesses in Switzerland. According to Court of Justice case-law, many of these flanking measures can only be acceptable if they are proportionate and protect a public interest that is not already protected in the state of origin of the service provider concerned. I think it is somewhat unfortunate that the Swiss authorities have decided to reintroduce quotas on the granting of residence permits for EU citizens who are nationals of the eight Member States that acceded to the EU in 2004, thereby restricting the freedom of movement introduced by the Agreement with the EU in 1999. I believe that, instead of introducing restrictive measures into the existing framework, both sides should take the appropriate steps towards the development of a more appropriate, effective and flexible system of cooperation that would further facilitate the free movement of people."@en1
