I believe that it is necessary to go to the Court of Justice of the European Union over the EU-US Agreement on the use and transfer of Passenger Name Records to the US Department of Homeland Security. The restriction of any fundamental rights and freedoms must be necessary, proportionate and set by law. It should be noted that this agreement contains many legal uncertainties with regard to its compliance with EU data protection legislation. The purpose of the agreement and the data retention period are neither clear nor precise. I believe that the list of data that will be transferred should be reduced.
