"Mr President, my question is addressed to Mr Andor. There is no doubt that if people are to exercise their freedom of movement and take up work in another European Union Member State, workers’ rights must be safeguarded and respected. This objective also guided the Commission during work on the enforcement directive concerning the posting of workers within the framework of the provision of services. An initial analysis of this directive prompts a number of questions. Is the Commission not afraid that the proposal to introduce a list of criteria for characterising both the existence of a genuine link between employers and their country of origin as well as the temporary nature of workers’ postings will not cause still greater difficulties in interpreting and implementing the directive than is currently the case? Many of the criteria proposed by the Commission do not take into account the diverse nature of businesses and services and may bring about the imposition of additional bureaucratic and financial burdens, particularly on small and medium-sized enterprises. Is the Commission not afraid that introduction of the principle of joint and several liability in all the Member States will lead indirectly to a reduction in the opportunities to provide services in the European Union construction sector, where this form of employment is the most popular? Fears over potential liability may cause employers to stop posting workers abroad."@en1
