"During the plenary session of March 2012, the European Parliament adopted the compromise text negotiated with the Council of the European Union on successions, which brings three years of work and discussions to a close. This text recognises the principle of the movement of authentic instruments, which means that an instrument will have the same probative effects (content, date) in one Member State as in the issuing Member State. Above all, it recognises the universal competence of notaries in spite of the different succession settlement systems within the European Union, which should guarantee more efficiency between the systems. Among the other noteworthy advances, the text introduces the European Certificate of Succession (ECS) in order to facilitate the quick settlement of an international succession. With this certificate, heirs and legatees will be able to assert their direct rights in the succession. Finally, the reserved share principle, which is not recognised in all Member States, is preserved."@en1
