"Article 255 of the Treaty establishing the European Community, as amended by the Treaty of Amsterdam, grants citizens of the European Union and natural or legal persons residing or having their registered office in a Member State, the right of access to European Parliament, Council and Commission documents. The principles and limits governing this right of access have been determined by Regulation (EC) No 1049/2001 regarding public access to European Parliament, Council and Commission documents, which became applicable on 3 December 2001. However, as a number of substantive changes have been made to the regulation, it should be recast in the interests of clarity and better comprehensibility. Transparency in the legislative process is of utmost importance for citizens. Therefore, institutions should actively disseminate documents that are part of the legislative process, and dissemination should also be encouraged in other areas. On account of the highly sensitive content of certain documents, it should be borne in mind under all circumstances that they should be treated in a special and responsible manner.
