"Mr President, the European Commission’s recent review of the application of EU criminal law in the area of deprivation of personal liberty confirmed a number of problems in this area in the Member States.
Member States’ and the European Court of Human Rights’ condemnation of the conditions for detaining people, the length of remand and judicial administration is only confirmed by the Commission’s recent findings. As questions relating to remand or the conditions for detention fall partially within the power of the Union, the Commission has little scope for involvement in this area, particularly in relation to the more frequent detention of other nationals or the application of the European arrest warrant or the European supervision order. The procedural requirements for holding suspects in remand, the maximum length of their detention and also the conditions in which they are held and their health care should be harmonised on the basis of EU standards in such a way as to eliminate differences between Member States in terms of detention conditions."@en1
