"Mr Lyon, when it comes to entitlement to aid, to financial support under the common agricultural policy, the principle is very clear: the beneficiary of the support is the person who works the land. That can be the owner if it is he who works the land, or else it can be the tenant. Therefore, if a farmer can clearly demonstrate with documentation that he works the land, he will be entitled to the aid. In any event, for the first pillar, in other words, direct payments, it is clearly the farmer who is the beneficiary of the support.
That is precisely why we decided to use 2011 as the reference year, that is, before the legislative proposals are announced, in order to avoid any speculation in circumstances where a landowner who lets land to farmers finds out that the conditions for entitlement to support have been reviewed, and takes the land away from the tenants and registers himself as a farmer. That is why the reference year is prior to the presentation of the legislative proposal.
The Member States will also have mechanisms to enable them to check these documents and ensure that the person requesting financial support is, in fact, the farmer and not the owner."@en1
