"At the plenary meeting on 12 May 2001, the President, in accordance with Article 6(2) of the Rules of Procedure, reported that he had received a letter from the prosecutor’s office in Vienna, forwarded to him on 29 April 2011 by the Permanent Representation of Austria to the European Union, containing a request for parliamentary immunity to be lifted from the MEP Hans-Peter Martin. The Vienna prosecutor intends to bring proceedings against him on the basis of a charge that he used State funds inappropriately to finance private expenditure and to settle inflated invoices presented to him by friends and business partners. The charges relate to the period of the election campaign for the European Parliament in 2008 and 2009. The MEP is also charged with misleading the auditors responsible for checking the use of funding.
During a hearing in the Committee on Legal Affairs, Mr Martin stated that the prosecution was the result of attempts by another fellow Member and his assistant to take his seat in the European Parliament. These include the illegal seizure of documents from the buildings of the European Parliament and interference with his e-mails. This was also the subject of a Member’s complaint to President Buzek. In my opinion, it is right to agree to the request from the Vienna prosecutor’s office to strip Mr Martin of his parliamentary immunity."@en1
