The current system of foreign direct investment, governed by a myriad of overlapping and sometimes conflicting bilateral investment treaties (BITs) of the Member States has to be replaced – in a reasonable time span – by a new framework of modern EU investment treaties consistent with cross-cutting EU policy goals. I also support the rapporteur’s position, which strongly supports the coexistence approach of the Commission’s proposal for a regulation. It is undoubtedly essential that, by way of an authorisation process, the Member States’ existing BITs remain in place and that, under clear conditions, Member States be allowed to renegotiate existing BITs, finalise pending ones, and enter into negotiations for new ones. Legal certainty will, however, remain a relative term as long as the transition of the investment protection regime is not completed, and given validity terms of existing BITs of Member States under international public law. I am voting for the report, with the caveat that there is a need to continue debating the matter so that it will have a better legal framework."@en1
