"Madam President, in the report on future European international investment policy, the rapporteur has drawn attention to many open questions regarding potential EU agreements. The first job of the EU is to protect the public interest of EU citizens, whom it represents in the areas entrusted to it by the Member States. However, the state-protected public interest often collides with the interests of aggressive foreign investors, who are frequently more skilful in international arbitration than the countries defending the interests of their citizens. The examples mentioned in the report of Argentina, the US and Canada provide concrete proof of this. There is, therefore, a real need to define the principles of protection precisely in order to prevent them from being interpreted incorrectly by various investors. However, this important and as yet unresolved question continues to be the international responsibility of the EU, particularly from a financial perspective, as it is not clear who would bear the financial burden of a judicial dispute lost by the EU. The Council of the European Union has not yet given a proper answer to this question."@en1
