One of the European Union’s main objectives is to maintain and develop an area of freedom, security and justice, in which freedom of movement of persons is guaranteed. The legal situation at European level regarding the law applicable to the divorce and legal separation of spouses of different nationalities is currently very confusing. This often leads to a ‘rush to court’ where one of the spouses applies for divorce before the other one does in order to ensure that the proceeding is governed by a given law which he or she regards as more favourable to his or her own interests. The purpose of the proposal for a regulation is to create legal certainty for the couples concerned and guarantee predictability and flexibility. I am therefore bound to agree with the rapporteur, Mr Zwiefka, who supports the substance of the rules for determining the law applicable to divorce and legal separation."@en1
