"Mr President, Minister, Commissioner, ladies and gentlemen, since its adoption and the heated debates that surrounded it, the Services Directive has somewhat faded into obscurity, but it is important to show that we are particularly vigilant in the crucial phase of its transposition. I question the interpretation of the provisions of Article 2 of the directive linked to the exclusion of social services from its scope. Notions such as ‘support for persons in need’ and ‘mandated providers’ seem restrictive when compared with the definition of social services used in certain Member States, and I am concerned that a deliberately strict interpretation may serve to justify the inclusion of whole swathes of these services in the scope of the directive. The exclusion of these services is a key element of the text and a guarantee for the citizens that the European social model will be protected. I hope that certain Member States, including France, will not take advantage of the transposition in order to liberalise social services, under the false pretext that they are complying with European laws. These problems to do with the integration of services of general interest demonstrate the need to have European legislation that is specific to them and not to stick to a default definition as part of a directive on commercial services."@en1
