"MEP Ortega proposes a means to deal with legal instruments called authentic acts. Authentic acts are principally concentrated in Member States that come from a civil law tradition where legislation provides the primary source of law, in contrast to common law traditions (e.g. Ireland and the United Kingdom) and their reliance on customary rights and privileges. In the civil law tradition an authentic act is one established by a competent public officer or a competent authority and covers not only the act, but also its content. This content ranges from financial transactions but also the realm of public records and official documents of that kind.
The motion for a Parliamentary Resolution aims to promote increased legislative intervention across Member States that possess such acts by considering their mutual recognition and application in specific areas. This proposal adds additional weight to pre-existing legislation and is of potential benefit for countries from this legal tradition."@en1
