"The European Parliament voted in favour of the proposal for mutual recognition by the legal authorities of the EU Member States of penal sentences that is, sentences that have been pronounced in another Member State in the absence of the accused party. Together with the European arrest warrant, this means that anyone is liable to be arrested and sentenced in any EU Member State in which they have been tried and sentenced by default, without ever being told or realising that proceedings have been brought against them. The problem is even greater for Member States such as Greece, where the legal system, at least for the most serious offences, does not recognise the possibility of the accused standing trial in their absence. This regulation crucially undermines the accused’s right to a fair trial. It destroys the right of the accused to a real defence; it has already led to violent reactions in legal bodies and associations throughout the EU. It is now becoming clear that harmonising the Member States’ penal systems and the so-called ‘communitarisation’ of criminal law being promoted by the EU are leading to the infringement of fundamental sovereign rights and of the rights of Member States to determine their own guarantees of protection in critical areas such as criminal proceedings."@en1
