"If I might mention lack of transparency, the Charter of Fundamental Rights states that in Europe ‘no one shall be condemned to the death penalty, or executed’. So far so good, but that is not the full picture. The basis for interpretation of that article is the framework of the European Convention and that lays down some unacceptable exceptions. For example, the States may reinstate the death penalty if there is an imminent danger of war. What kind of a idea is that, ladies and gentlemen?
That same source of law gives law enforcement officers licence to kill in the event of insurrection and even authorises, to quote once again ‘preventive detention’.
