"Madam President, the Commissioner has replied as I anticipated, as I am aware of the value he places on the institutions of the rule of law. The problem is that the Constitutional Treaty is still at an indeterminate point: we do not know if we will succeed in concluding it and in the meantime we must operate in this Community, tackling terrorist crimes on the one hand and on the other ensuring legal certainty. The question I would raise with the Commissioner is, in the light of the lack of will on the part of some States to take on commitments before the Court of Justice, whether he believes it is appropriate for us to continue to adopt anti-terrorist measures if at the same time such measures are not coupled with a strengthening of the courts. In other words, each time a measure of this type is adopted, the Member States should enter into a commitment to acknowledge the jurisdiction of the Court of Justice. Otherwise, we will be faced with the possibility of authoritarian or coercive methods being adopted without the possibility of recourse to the Court."@en1
