". Madam President, I shall be very brief because I do not disagree, but it all depends on the context. I shall not go into the legal argument now, but we will take everything into account. I have said from the beginning, and I do not hesitate to say this publicly, that I believe policy decisions should be taken by the policymakers, not by the courts. We will have the opportunity to discuss a specific proposal, but always bear in mind the parts of the Court’s judgments that interpret the Treaty. When it is the Treaty, which is the ultimate legal instrument in the European Union, legislation has to comply with that. When it is not the Treaty, we have flexibility. However, as I have said, we have legal services to advise us on that. Let us agree on the policies first and then we will find a legal way of doing it."@en1
