"Mr President, the temporary PNR agreement with the United States continues to treat as non-binding the US unilateral undertakings for the proper use and protection of personal data in the form of a protocol. Why? And how is it possible that the European Council in this case concluded an agreement that seems more flexible on US obligations than even the agreement that a mere private company, SWIFT, was apparently able to negotiate with US authorities for the unacceptable transfer of banking data? SWIFT, for example, has claimed that it can in real time block any US search if it violates the causes for which it has been agreed. The PNR and SWIFT cases reveal a dangerous political and legal black hole in the protection of our fundamental rights. A third country invoking exclusively reasons of its own national security can apparently impose upon Europe, including directly upon private companies, the level of access to, use, and even protection of, data. This is clearly unacceptable, and, while the whole EU pillar structure has de facto collapsed in these two cases, the Council insists upon denying Parliament the role of an equal partner in fighting terrorism and in protecting fundamental rights. What is now urgently needed is a comprehensive and democratic European approach in cooperation with all our partners on a global level to deal with these issues in the future."@en1
