"Mr President, one of the issues we are supposed to be looking at is whether the European Union and our own Member States are the good guys in this. This is a question that we need to ask. In terms of facts and the political consequences that we should be drawing from this, it is almost irrelevant whether there have been two or three renditions as we were told in the US by the US Administration, or whether the facts unearthed so far reveal two or three renditions, or whether we have found more. We have discovered that Member States, even if they want to know what is going on, do not necessarily have the right or the mechanisms to find out, let alone the political will. We have been told by two of our own senior people that they do not have the right to pursue such issues. We have been told that the law is inadequate in this new era of greater threat. However, we also need to question whether we are using the law we have effectively and fairly in accordance with international human rights obligations. The issue is not just about the method – whether it is abduction or immigration problems – but also the outcome. There is an absolute prohibition on torture under international human rights instruments. Therefore, what do we make of the memoranda of understanding which are increasingly coming into play and have implications for other areas of EU policy? These are some of the areas we should be looking at politically. This is another reason why we need the committee to continue."@en1
