"Mr President, the dangers posed to traditional British liberties by the European Arrest Warrant are demonstrated by the case of my constituent, Malcolm Cubin. Mr Cubin is one of three divers threatened with extradition to Spain on charges of damaging Spanish heritage and stealing artefacts from a wreck. Mr Cubin maintains that those are trumped-up charges and that no evidence has been produced to substantiate them. It used to be that evidence had to be submitted to a British court before a British citizen could be extradited. The crime in question had to be recognised as such and a proper legal system had to be recognised in the country requesting extradition. All those safeguards are now gone and, providing the extradition form has been filled out correctly, a British citizen can be shipped off with as little ceremony as posting a parcel. The British Government should refuse to allow Mr Cubin and his colleagues to be extradited until proper evidence has been produced and it is satisfied there will be a fair hearing."@en1
