"I voted in favour of the report by my fellow Member, Mrs Frassoni, on the recent reports by the European Commission on monitoring the application of Community law. This report was keenly awaited in the wake of the Interinstitutional Agreement of December 2003. Known as Better Lawmaking, the agreement was aimed at reducing the volume of Community law at the same time as simplifying it and was designed to ensure that the legislation was properly applied everywhere, this being a necessary condition of creating an area of justice. Unfortunately, it has to be said that the Member States are bad at transposing Community law. Worse, they apply it badly and do so with an impunity in which the European Commission is complicit. It should be remembered that it is the Member States that are responsible for monitoring the application of Community law. Everyone can see the degree to which the present system does not work and how it helps create a gulf between, on the one hand, European integration and, on the other, Europeans, who are aware of the injustice of this situation every day. I wonder if the time may not have come to consider creating a European body of independent inspectors with the task of monitoring the application of Community law in the Member States."@en1
