"The June List broadly supports the compromise agreed between the Council, the Commission and Parliament. On many points, the Code clarifies previously unclear rules derived from a range of legal sources. We particularly welcome the increased protection against discrimination in the implementation of border controls, as well as the opportunities for third-country citizens who have been refused entry to a country to appeal against the decisions made.
We do not, however, share the rapporteur’s view that the EC Court of Justice should be given the power to give judgment on issues concerning the reintroduction of internal border controls, and we therefore welcome the fact that the Council has not accepted these proposals. The June List believes that each Member State should be allowed to reserve the right to reintroduce its border controls if it considers this to be necessary in order to combat drug smuggling and illegal human and other trafficking and if it is required to withdraw from Schengen cooperation."@en1
