Mergers between undertakings are regulated both by the relevant basic articles of the Treaty and by Regulation (EC) 139/2004, which stipulates that the review of concentration practices falls exclusively within the Commission's competence and that, consequently, the Member States may not apply their national competition laws (exclusivity principle) except in specific cases where the Commission itself considers national intervention necessary.
What approach will the Commission take to the operation of groups and mergers in the media and the definition of dominant market position in relation to the media, with the aim of fostering pluralism and objective information?"@en1
