"Mr President, I should like to draw the attention of the House to the current state of affairs regarding the Treaty establishing a Constitution for Europe. This Treaty, which was signed in October 2004, is currently awaiting ratification before it enters into force. The question that therefore arises is as follows: what obligations are incumbent upon a state that has signed the Treaty but not yet ratified it? The answer to this question can be found in international law, in particular the Vienna Convention on the Law of Treaties. Article 18 of this Convention states that a state in this position is obliged to refrain from acts which would hinder or preclude the entry into force of the agreement in question, or which would defeat the agreement’s object and purpose. What this means is that governments are obliged under international law to take all steps necessary to ensure that the European Constitution is ratified. It therefore follows that neither states nor governments should in any way support or tolerate anti-Constitution campaigns.
