That part of the project will be replaced by a new one once the full procedure of identifying impacts and exploring alternatives has been completed. That means that it would, in any case, be a new project and that the old procedure may have to be discontinued. In that case, should the Commission consider that the new project does not comply with European Community law, a new procedure would be initiated afresh. The Spanish authorities provided information on these developments in February 2004. The infringement covers only the non-implemented part of the project.
