Hedkvist Petersen, I fully agree with you and I would draw your attention to the fact that the European arrest order must respect fundamental rights, and specifically the principles laid down in Article 6 of the Treaty on European Union, which refers to the European Convention on Human Rights in the field of procedural safeguards. And when an individual’s freedom is under threat, the European Convention on Human Rights clearly provides for the possibility of revision by referral to a judicial body.
Following this consultation, the Commission intends to look into whether a legislative measure is needed at European level to approximate these rules, which are common to the Member States and which are contained in the European Convention on Human Rights and, in this way, to increase mutual trust between Member States, whilst at the same time providing guarantees of legal certainty. I hope to be able to present the conclusions of this investigation to Parliament and the Council at the end of this year."@en1
