Article 91 of Regulation (EC) 40/94requires the Member States to set up at least one court to deal with private disputes arising from Community trade marks. Some countries have set up such courts, including Spain, which faces an additional difficulty because, under the provisions of the regulation, it is the Spanish court which has jurisdiction in disputes between non-Community undertakings.
What measures does the Commission plan to take to ensure that Member States which have not yet done so set up Community trade mark courts?"@en1
