Without underestimating the importance of fundamental rights to the citizens of the Union, the non-attached members in the European Parliament abstained during the vote for two reasons. First, because problems with the text of the Charter (such as the ban on the reproductive but not the therapeutic cloning of human beings) precluded a vote in favour and, secondly, because the convention as an instrument of future constitutional development would appear to be more than dubious. However, what worries us most is that the twin-track jurisdiction of the European Court of Justice and the European Court of Human Rights will give rise to inconsistent case law, resulting in the unequal treatment of citizens in these sensitive areas, in breach of their fundamental rights. We are also convinced that merely having national parliamentarians on board is no substitute for an in-depth debate of constitutional questions by the national parliaments."@en1
