"The freedom of establishment and the increased mobility of companies between Member States have highlighted the need for better coordination and a greater degree of harmonisation of insolvency law in order to combat the adverse impact of ‘insolvency tourism’ on employees. Even though employment law is the responsibility of Member States, insolvency law can have an impact on employment law and, in the context of increased globalisation and, indeed, of the economic crisis, the issue of insolvency needs to be considered from an employment law perspective.
I am concerned to note the growing number of workers, especially women and people over the age of 45, affected by insolvency procedures. This situation can be attributed to the very severe economic and social impact the financial and economic crisis is having, and the nature of systemically-relevant, cross-border financial institutions increases their role in this area. I welcome the fact that Directive 2008/94/EC on the protection of employees in the event of their employer becoming insolvent explicitly includes in its scope part-time employees, employees on fixed-term contracts and employees in a temporary employment relationship. Nevertheless, I feel it is necessary to increase the protection afforded in the event of insolvency, even for workers on non-standard contracts."@en1
