"Ms Steinruck, first of all, let me thank you for your earlier intervention, in the summer, on this topic, as a result of which I raised this issue at my recent meeting with Minister Bertrand in France and received information that the French authorities were also looking at this case very seriously. This is exactly the type of situation which justifies the Commission’s efforts to deliver a new enforcement directive on the posting of workers. I believe it is necessary, because in previous years, there have been a huge number of cases – some of them very well-known following court rulings, but there are many that are less well-known – where workers, but also entrepreneurs, found themselves in very difficult situations because of the lack of clarity, and the lack of clear interpretation and implementation of the Posting of Workers Directive.
We are delivering an enforcement directive later this year. It is a strategic initiative in the Commission’s work programme for this year, and this will also be accompanied by a so-called ‘Monti II’ regulation. I think this will form a good and balanced package.
I have been discussing this also with the Polish Presidency which has a strong interest in this, also because in some cases, like the one you referred to, there are Polish workers involved, though it is true that Germany is also a country which receives and sends a huge number of posted workers, so I also count on German stakeholders to participate in this debate."@en1
