"In May 2008, the European Union adopted a directive on mediation which had been under way since 2004. Its aim: to promote the amicable settlement of disputes and ensure a balanced relationship between mediation and judicial proceedings. It is clear that well-designed mediation procedures are a cheaper and quicker alternative to judicial proceedings, and have the added bonus of preserving the relationship that was built up before the start of the dispute. This report, which I endorsed, looks in detail at how the Member States have transposed the main provisions of this legislative act. It transpires that, although the regulatory approaches vary, and there are some slight delays, the majority of the Member States not only meet the requirements of the directive but even exceed them, which I am pleased about. Looking ahead to the publication of the legislative proposal on alternative dispute resolution this year, and of the Commission communication on the implementation of the Mediation Directive in 2013, this in-depth study was necessary for many reasons. It has also enabled us to seek the opinion of practitioners and users of mediation, and to identify ways of improving it."@en1
