"I should like to mention a case in which the Treaties have been violated by several Member States. The House must surely be aware that in accordance with the provisions of the Treaty on Accession, one of the signatories to which was the European Union, Polish entrepreneurs have the right to provide services freely in all Member States. This is one of the EU’s fundamental freedoms, which was not waived due to accession negotiations and which all Polish citizens could enjoy from day one of membership of the European Union. The transitional periods imposed apply only to persons wishing to take up employment on the basis of a contract of employment, and not to persons providing services or taking up activities on a self-employed basis. Yet in many Member States Polish service providers fulfilling orders placed by local customers, as well as persons wishing to open their own service establishments, have met with additional administrative requirements which make it difficult to take up such activities. If necessary, I can give details of the countries where this is the case. I therefore believe that the European Commission should be asked what measures it intends to take in order to examine these practices and to prevent actions such as these that violate the Treaties currently in force."@en1
